Equal Employment Opportunity (EEO) Requirements:

Prior to the award of a state contract, these forms must be submitted:

• MWBE/EEO Policy Statement (OTDA-4970)
• Staffing Plan (OTDA-4934)

After the award of the state contract, this form must be submitted by the contractor quarterly:

• Workforce Employment Utilization/Compliance Report (OTDA-4971) (XLS)
• Standard Occupational Classification Codes (SOC Codes)
• Workforce Utilization/Compliance Report for Grants (OTDA-4971-G) (XLS)

MWBE Requirements:

Prior to the award of a state contract, these forms must be submitted:

• MWBE Subcontractor Utilization Plan (OTDA-4937)
• MWBE Subcontractor and Supplier Letter of Intent to Participate (OTDA-4938)
• MWBE Certification of Good Faith Efforts Form (OTDA-4976)
• MWBE Subcontractor Request for Waiver Form (OTDA-4969)
• HHAP M/WBE Subcontractor and Supplier Letter of Intent to Participate

After the award of the state contract, these forms must be submitted by the contractor quarterly:

• MWBE Subcontractor Quarterly Compliance Report (OTDA-4968)
• MWBE Subcontractor Request for Waiver Form (OTDA-4969)

Please note that all forms and reports must be submitted to OTDA program managers, and they will forward these documents for review and approval to:
